FROZEN!

Question:  Can I sue my neighbor who told me to stick my tongue on a frozen metal bar outside?  When I tore my tongue off the piece of metal it pulled the skin with it.  Ouch!

Answer:  Beware of the legal doctrine assumption of the risk.  It involves venturousness and involves a subjective test of whether plaintiff fully understood the nature and extent of a known danger and voluntarily exposed herself to it. A successful assumption of the risk defense is a complete bar to recovery.
